These Terms and Conditions (“Terms”) govern your use of our services, including tours, safaris, vacations, corporate team-building events, and business trips. By booking with us, you agree to comply with and be bound by these Terms. Please read them carefully before proceeding with any booking.
1. Definitions
- Client: The person or entity making a booking with Gemini Expeditions.
- Services: The travel, tours, safaris, beach holidays, corporate events, and other travel-related services provided by Gemini Expeditions.
- Force Majeure: Unforeseeable circumstances beyond our control, including but not limited to natural disasters, political instability, pandemics, or government restrictions.
2. Booking and Payment
2.1 Reservation:
- A booking is confirmed only upon receipt of a deposit or full payment as specified in the invoice.
- All bookings are subject to availability.
2.2 Payment Terms:
- A non-refundable deposit of at least 30% is required at the time of booking.
- Full payment must be received no later than 14 days before the start of the trip.
2.3 Methods of Payment:
- Payments can be made via bank transfer, credit card, PayPal, mobile money or other approved methods. Any transaction fees are the responsibility of the Client.

3. Cancellations and Refunds
3.1 Cancellation by the Client:
- Cancellations must be made in writing via mail or electronic mail.
- Cancellation fees apply as follows:
- More than 14 days before departure: 25% of the total cost.
- 13 to 4 days before departure: 50% of the total cost.
- Less than 4 days before departure: 100% of the total cost.
Clients are subject to the cancellation policies of hotels, resorts, drivers, and any other suppliers involved in the booking.
3.2 Cancellation by Gemini Expeditions:
- We reserve the right to cancel a trip due to Force Majeure or insufficient bookings. In such cases, a full refund will be provided, excluding any third-party costs.
3.3 No Show:
- No refunds will be provided for no-shows or unused services.
4. Changes to Bookings
4.1 By the Client:
- Any changes requested by the Client are subject to availability and may incur additional charges.
4.2 By Gemini Expeditions:
- We reserve the right to make minor changes to itineraries due to unforeseen circumstances. Significant changes will be communicated promptly, and alternatives will be offered where possible.
5. Client Responsibilities
- Ensure that all travel documents (e.g., national identification cards, passports, visas) are valid and meet the requirements of the destination.
- Obtain travel insurance as necessary to cover medical expenses, trip cancellations, and other potential risks.
- Adhere to the laws, customs, and regulations of the destination.
- Inform Gemini Expeditions of any medical conditions or dietary requirements prior to travel.
6. Liability and Disclaimers
6.1 Limitation of Liability:
- Gemini Expeditions is not liable for any injury, loss, or damage resulting from circumstances beyond our control, including but not limited to Force Majeure events.
- We act as an agent for third-party service providers (e.g., hotels, airlines) and are not liable for their acts or omissions.
6.2 Indemnification:
- The Client agrees to indemnify and hold Gemini Expeditions harmless against any claims, damages, or losses arising from their actions or omissions.
7. Force Majeure
- Gemini Expeditions is not responsible for delays, cancellations, or additional expenses resulting from Force Majeure events. In such cases, refunds or rescheduling will be at our discretion.
8. Governing Law
- These Terms are governed by the laws of the Republic of Kenya.
- Any disputes shall be resolved in the courts of Nairobi, Kenya.
